Terms of Service
What ProductGuard is
ProductGuard is a hybrid AI and human product compliance review service for CPG brands. It reviews product labels, packaging, listing copy, advertising, marketing claims, and ingredient declarations. AI-powered analysis organizes and prioritizes findings from the materials you submit and from publicly available regulatory guidance and documented enforcement patterns. Human verification is part of the reviewed-report workflow. A preliminary automated scan is separate from a human-reviewed report.
No attorney-client relationship
Use of ProductGuard does not create an attorney-client relationship, and nothing generated by the service should be treated as legal advice. We are not a law firm and do not employ attorneys to review individual scan results.
No guarantee of outcome
A "Low Risk" or "No high-priority signals detected" result does not guarantee that a product will not face regulatory action, marketplace delisting, or legal claims. Conversely, flagged findings do not constitute proof of a violation. Regulatory outcomes depend on facts beyond what can be assessed from label content alone, including manufacturing records, substantiation files, and jurisdiction-specific requirements.
Suggested language and fixes
Suggested wording in a report is a draft for your team to edit against the product and the evidence. It is not finished label copy.
State and international law
ProductGuard's review focuses primarily on U.S. federal regulatory frameworks (FDA, FTC) along with select state-level requirements such as California Proposition 65. State-level Unfair and Deceptive Acts and Practices (UDAP) statutes, additional state requirements, and international regulations may also apply depending on where your product is sold and are not comprehensively covered by this service.
Acceptable use
ProductGuard is intended for screening genuine product labels, listings, claims, and ingredient content. Intentional misuse of the scanning system — including submitting unrelated or fraudulent content to circumvent usage limits — may result in account suspension.
Payment and refunds
ProductGuard may offer paid services — including pilot programs, subscriptions, human-reviewed reports, product monitoring, and individually purchased deliverables — depending on the arrangement agreed with you. Where payment applies, fees, scope, and delivery terms are confirmed before work begins. Digital deliverables are provided upon successful payment unless otherwise agreed. Refund requests are evaluated on a case-by-case basis — contact us if you believe a deliverable was generated in error or does not match agreed scope.
Limitation of liability
To the maximum extent permitted by law, ProductGuard is not liable for any damages arising from reliance on its output, including but not limited to lost sales, marketplace delisting, regulatory penalties, or legal costs.
Changes to these terms
We may update these terms as ProductGuard evolves. Continued use of the service after changes are posted constitutes acceptance of the updated terms.
